À la suite du référendum d’indépendance d’octobre 2017 en Catalogne, la Cour suprême espagnole a condamné douze hauts responsables politiques et leaders de la société civile catalans pour leur implication présumée dans son organisation. Neuf d’entre eux purgent une peine de neuf à treize ans de prison sous l’accusation de sédition. L’ensemble des condamnations s’élève à cent ans de prison. Sept autres politiciens de haut rang se sont exilés en Belgique, en Suisse et en Écosse. En outre, depuis le référendum, plusieurs centaines de citoyens catalans, maires, conseillers municipaux, fonctionnaires et militants, ont été ou sont toujours inculpés ou poursuivis en justice en rapport avec le processus du référendum sur l’indépendance. Un autre procès a été récemment lancé par le procureur de l’État contre l’ancien président du Parlement catalan et des membres du bureau pour avoir autorisé des débats parlementaires et des motions sur l’autodétermination.
Après avoir suivi le procès et examiné le jugement, Amnesty International a déclaré que l’interprétation du crime de sédition par la Cour suprême était contraire au principe de légalité et permettait d’imposer des restrictions disproportionnées. En 2020, le Groupe de travail des Nations unies sur les détentions arbitraires a demandé la libération des dirigeants indépendantistes catalans.
De plus, les résultats des élections au Parlement catalan qui ont eu lieu le 14 février 2021, ont montré une remarquable résilience du mouvement indépendantiste avec un soutien de 52%.
Pour toutes les raisons susmentionnées, les soussignés, membres du Parlement européen et des parlements nationaux, estiment que le moment est venu de prendre des mesures courageuses en vue de la normalisation et de la résolution du conflit par des moyens purement démocratiques. Cependant, aucune normalisation ne peut se faire avec des dirigeants indépendantistes en prison ou en exil et sans mettre fin aux poursuites judiciaires à l’encontre des nombreux partisans de l’indépendance qui font encore l’objet d’accusations.
Par conséquent, nous vous demandons de soutenir et de promouvoir une amnistie – avec tous les changements juridiques et institutionnels nécessaires – comme point de départ pour permettre un processus significatif et complet de dialogue et de négociation pour une solution politique au conflit, basée sur des principes démocratiques, le respect mutuel et le plein respect des droits démocratiques du peuple catalan.
